What’s in a name? Quite a lot, if you’re in the tech industry, and moreso if you’re Amazon or Apple.
Apple’s attempts to keep the “app store” monicker to themselves have taken a new turn with the release of the Kindle Fire, as the company added an amendment to their existing complaint to maintain the “app store” name as a strictly Apple concoction.
The new filing makes mention of Amazon’s use of the ” Amazon Appstore” in order to market the Kindle Fire. According to the complaint, Amazon has been slowly adjusting its use of the “Appstore” name. What was once originally advertised as the “Amazon Appstore for Android” has had the “for Android” portion either deempahsized or removed entirely.
The complaint thus states that “Amazon’s ongoing unlawful use of the APP STORE mark has irreparably harmed Apple, and Amazon’s threatened expansion and/or alteration of that unlawful use will increase the irreparable harm to Apple.”
